You probably only looked down at the car radio for a second, but that second looking away from the road is all it took to not see an accident coming your way. Now what? You’re certain the accident was your fault, so what should you do? Keep the following in mind when you find yourself in this situation.

Remain Neutral

Don’t get out of your car yelling and screaming at the other driver in an attempt to direct fault to him or her. Don’t accept fault for yourself, either. When the responding police officer shows up, he or she will want your statement about what happened. Tell your version of events, but do not apologize, admit fault or go overboard trying to make the other party look guilty.

Contact Your Insurance Provider

It’s your legal responsibility to contact your insurance provider and report your accident. Again, don’t admit fault to your insurer. If you’re in the middle of receiving medical assistance, just make the report and be done. You or your lawyer can be in touch with the insurance provider at a later time.

Exchange Contact and Insurance Information

Fault doesn’t matter when it comes to collecting contact and insurance information from the other driver. You’ll want this information whether you are solidly determined to be at fault if you’re partially at fault or found to not be at fault after all.

Take Pictures of the Scene

It’s possible you’re not really at fault, even though you thought you were. Take pictures of the scene, of the vehicle damage and of your injuries. Putting the pictures together with witness accounts and the police report could tell a different story that clears you of fault.

Stay Off the Phone

Obviously, there are some phone calls you will make after an accident, but don’t indulge in phone calls from the other driver’s insurance company or anyone else affiliated with the other driver. His or her insurer might call you with an offer they are hoping will make the case go away. Simply refer the insurer to your lawyer and hang up.
