Attempted Criminal Charges

Published on October 16th, 2020

When an individual is charged with an attempt this means that they attempted to commit a criminal offense. Although the attempt was not successful you can still be seen as responsible for that attempt in anything that attempt and I have a lead soon. The laws for attempted charges vary from state to state so it is important if you are someone you know has been charged with an attempted anything To contact a criminal defense attorney as soon as possible. The most popular attempted a fit that you may have heard it is attempted murder, unfortunately, there are several criminal charges that can be charged under attempted offenses in these offenses are punishable by law and can incur jail time or fines.

Much like any other criminal charge, The city or state that pursues criminal charges against you are responsible for proving that the crime an individual is being alleged has actually occurred or was attempted and it was by the accused party. Because it is an attempt charge, one of the most important things the prosecution will need to discover is intent. If the prosecution cannot prove that the accused party had an intention to commit the crime they are charged with attempting it is almost impossible to convince that individual.  obviously, the details of the incident mean a lot in these cases. While A conviction may occur although there are no tents discovered, having the intent be proven helps a prosecutor secure a conviction.

In attempted criminal offense charges it is important to know that intent is not the same as preparing to commit a criminal offense. For example, you may go into the store and buy duct tape, rope, a shovel, and any other additional items that are used in kidnappings or even murders. However, the purchasing of these items do not mean there is an intent. Intent becomes a part in your case when you are found, maybe following the injured or harmed individual, walking into their home, tying them up with that rope, placing that duct tape on their mouth, and striking them over the head with that shovel. While they may not lose unconsciousness and be able to submit to your desires because they fought back, this does not mean you did not attempt to kidnap them. This is when intent enters the room.

When you make a decision to commit a crime, prepare to commit the crime, and start the commission of that crime, no matter if you are successful or not you can now be charged with an attempt. Contact a criminal defense attorney, like from The Lynch Law Group, as soon as possible if you know someone that has been charged with an attempted criminal offense.
