Types of Car Accident Cases We Handle in Edwardsville

Illinois Legal Requirements for Car Accident Claims

Several Illinois statutes directly affect how car accident claims work. If you’ve been hurt in a crash in Edwardsville, here is what you need to know.

The statute of limitations for car accident injuries in Illinois is two years from the date of the crash under 735 ILCS 5/13-202. If someone dies as a result of injuries sustained in the accident, the Illinois Wrongful Death Act (740 ILCS 180) provides a two-year filing window measured from the date of death. Once these deadlines pass, the court will dismiss your case. There are very limited exceptions, and none of them are routine.

Illinois follows a modified comparative negligence rule under 735 ILCS 5/2-1116. Illinois is a fault-based state for car accidents. That means the person who caused the crash, or their insurer, is responsible for paying damages. You can pursue a claim through the at-fault driver’s liability insurance, file a lawsuit in civil court, or both. Illinois requires all drivers to carry minimum liability coverage of $25,000 per person and $50,000 per accident for bodily injury under 625 ILCS 5/7-601. In practice, those minimums are far too low to cover the costs of a serious crash.

Illinois law also requires drivers to report any accident that results in injury, death, or property damage over $1,500 to the Illinois Department of Transportation. Filing a police report at the scene creates an official record that can be valuable evidence in your claim.

What Damages Are Recoverable in Edwardsville Car Accident Cases?

If the at-fault driver was drunk, fleeing law enforcement, street racing, or knowingly driving without a license, punitive damages may be on the table. Following a 2023 amendment to Illinois law, punitive damages are now also available in wrongful death and survival actions, with exceptions for medical malpractice and government defendants.
