Under the Illinois Wrongful Death Act (740 ILCS 180), families who lose a loved one in a fatal truck crash can pursue a wrongful death claim against the at-fault driver, the trucking company, or both. The statute of limitations for personal injury cases in Illinois is two years from the date of the accident under 735 ILCS 5/13-202. For wrongful death claims, the deadline is two years from the date of death.

Illinois follows a modified comparative negligence standard. If you are found to be more than 50% at fault for the crash, you cannot recover damages. If your fault is 50% or less, your compensation is reduced by your percentage of responsibility.
